The Office of Financial Regulation is accountable for the advancement and/or supervision of certain elements of the foreclosure procedure including domestic home and receives particular notifications.

The Office of Financial Regulation is responsible for the advancement and/or supervision of specific elements of the foreclosure process including domestic home and receives certain notifications and registrations related to the foreclosure procedure. Specifically, the Office promulgates regulations relating to the kinds, series of files, and certain procedures to be used as part of the foreclosure procedure, consisting of, but not limited to:


- the format and material of the Notice of Intent to Foreclose, the template loss mitigation application, the preliminary loss mitigation affidavit, the final loss mitigation affidavit, the notice to accompany the order to docket;
- the fee, notice, application and guidelines for prefile mediation, and a mediation checklist that describes the matters that shall be reviewed and thought about in a prefile mediation; and
- the demand type for postfile mediation, the files and info to be offered by each party to the mediation, and a mediation list that describes the matters that shall be examined and thought about in a postfile mediation

.18. Foreclosure Notices and Registrations


The Office administers Maryland's Foreclosure Registration System, a web-based application for submission of the foreclosure-related notifications and registrations that are mandated by Maryland law. Specifically, the system enables authorized users to submit and/or search the following foreclosure-related notifications and registrations:


- The Notice of Intent to Foreclose is a caution notice to the property owner that a foreclosure action could be submitted against them in court. It should be sent out by accredited and first-rate mail to the house owner no less than 45 days before a foreclosure action might be submitted in court. Pursuant to Maryland law and regulation, a copy of the Notice of Intent to Foreclose need to be electronically sent to the Commissioner through the Foreclosure Registration System within 5 organization days of sending by mail a Notification of Intent to Foreclose. The Commissioner does not accept submissions in any other way. Filing a copy of the Notice of Intent to Foreclosure with the Commissioner must be achieved before a party is authorized to file an action to foreclose a mortgage or deed of trust on house. Failure to comply with this requirement will subject a lawbreaker to the enforcement jurisdiction of the Commissioner. Refer to Md. 7-105.2.-The Foreclosed Residential or commercial property Registration is intended to track owner contact info for foreclosed residential or commercial properties between the date of the foreclosure sale and recordation of the deed moving the residential or commercial property to the brand-new owner. The Foreclosed Residential or commercial property Registration includes contact information for the buyer, the party accountable for upkeep of the residential or commercial property, and the entity licensed to accept legal service on behalf of the purchaser, in addition to other pertinent information such as whether the residential or commercial property is known to be occupied, the date of the sale, and the date of court ratification. This details is intended, in part, to enable city governments to attend to problems associated with the residential or commercial property, such as code enforcement, problem reduction, residential or commercial property upkeep, law enforcement, public security, public health, emergency situation services (fire, EMS), to notify public law (i.e. information collection to identify patterns, develop policy actions, and so on), and to aid in the collection of pertinent taxes. Within thirty days after a foreclosure sale of house, a foreclosure purchaser will send an Initial Registration ($50 filing charge if timely/$100 filing charge if late) and within one month after a deed transferring title to the domestic home has actually been recorded, the foreclosure purchaser will submit a Last Registration (no filing cost). .14. After Initial Registration, and within 21 business days of a modification, a foreclosure purchaser should update its registration with any modification in 1) the name and address of the individual, including a substitute buyer, who is licensed to accept legal service for the foreclosure buyer, 2) if understood, the occupancy/vacancy status of the residential or commercial property, 3) the name, telephone number, and street address of the person who is responsible for the maintenance of the residential or commercial property, and 4) the status of whether the foreclosure purchaser has belongings of the residential or commercial property.


NOTE: Specific notice and registration details in the Foreclosure Registration System is typically private and is not public details. Maryland State and Local Government Officials may be licensed in their main capability to see Notices of Foreclosure or Foreclosed Residential Or Commercial Property Registrations (for their particular jurisdictions just) by establishing a Government User account in the Foreclosure Registration System. Additionally, a property owner's association or condo in which a residential or commercial property in questions lies, or an individual who owns residential or commercial property on the exact same block as a residential or commercial property in concern, may request from OFR or regional jurisdiction particular details related to a Notification of Foreclosure or Foreclosed Residential Or Commercial Property Registration.
